An array of new rules and regulations related to pain medication have been enacted recently. They include the E-FORCSE Prescription Drug Monitoring Program that went live October 18, 2011; the December 31, 2011 Controlled Substance Prescriber registration deadline for physicians who prescribe controlled substances for non-exempted, chronic, nonmalignant pain; and the new pain-clinic regulations and exemptions. In addition to these new rules, the existing regulations for storing and prescribing controlled substances remain in effect.
The new regulations are confusing because they vary as to which physicians they govern. There is a new regulation for M.D.s; a regulation for D.O.s that applies without exception; a new statute that applies to some physicians and not others; new prescription procedures and safeguard rules; and there is a new Florida Online Reporting of Controlled Substances Evaluation (E-FORCSE) database that pain medication prescribers must update.
We have summarized the basic components of these rules to help physicians determine what applies to them and what does not. Further, we have included an overview and checklist from Dr. Pariksith Singh to assist practitioners in pain management compliance in their offices (see Chapter 10).
